1. Agreement

By accessing or using the elev8 website and services (including business consulting, app development, simple websites, the free website program, and the affiliate program), you agree to these Terms of Service. If you do not agree, do not use our services.

2. Services

elev8 provides consulting, web development, website design, and related offerings. Specific terms, scope, and pricing for projects or programs may be set out in separate agreements, proposals, or program rules. We reserve the right to modify, suspend, or discontinue any service with reasonable notice where practicable.

3. Your Obligations

You agree to:

• Provide accurate information and cooperate in delivering projects
• Use our services only for lawful purposes and not in a way that harms us or others
• Comply with any program-specific rules (e.g., affiliate program terms)
• Not misuse our systems, content, or intellectual property

4. Intellectual Property

elev8 and its licensors own the content, branding, and materials on this site unless otherwise stated. Deliverables and ownership of work product will be as agreed in your project or program agreement. You may not copy, modify, or distribute our materials without permission.

5. Disclaimers

Our services are provided "as is" to the extent permitted by law. We do not guarantee specific business outcomes, uninterrupted service, or that the site will be error-free. Advice and deliverables are for your use; you are responsible for your business decisions.

6. Limitation of Liability

To the maximum extent permitted by law, elev8 and its owners and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits or data, arising from your use of our services or these terms. Our total liability shall not exceed the amount you paid us for the relevant service in the twelve months preceding the claim.

7. Indemnification

You agree to indemnify and hold elev8 harmless from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of our services, your breach of these terms, or your violation of any law or third-party rights.

8. Termination

We may suspend or terminate your access to our services or participation in programs if you breach these terms or for other reasonable cause. Provisions that by their nature should survive (e.g., disclaimers, limitation of liability, indemnification) will survive termination.

9. General

These terms are governed by the laws of the State of Washington. Any dispute shall be resolved in the courts of Clark County, Washington. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a right does not waive it. We may update these terms; continued use after changes constitutes acceptance.
